Parliament, Tuesday, 23 January 2024 – The Select Committee on Security and Justice has extended the deadline for written submissions on the Independent Police Investigative Directorate (IPID) Amendment Bill [B21B-2023]. The new date is now 2 February 2024.

The Bill seeks to amend the IPID Act, 2011, in order to provide for IPID’s institutional and operational independence. This is to ensure that IPID is impartial and can exercise its powers and functions without fear, favour, prejudice or undue influence in order to give effect to the judgment of the Constitutional Court in the case of McBride v Minister of Police and Another.

The amendment Bill further aims to amend the provisions relating to the appointment of the directorate’s executive director and broaden the responsibilities of that role relating to the referral of recommendations regarding disciplinary matters; to provide for the pre-employment security screening investigations to be conducted by IPID; and to provide for the conditions of service of investigators to be determined by the Minister.

Committee Chairperson Ms Shahidabibi Shaikh said the Bill also aims to provide for IPID to investigate any deaths caused by the actions of South African Police Service (SAPS) members or members of a municipal police service, whether the member was on or off duty; to provide for IPID to investigate a rape committed by a SAPS member or a member of a municipal police service, whether the member was on or off duty; to strengthen the provisions relating to the implementation of disciplinary recommendations; to provide for a savings provision regarding the conditions of service of existing investigators and provincial heads; and to amend other provisions so as to ensure that IPID executes its mandate effectively and efficiently.
