Parliament, Wednesday, 31 August 2022 – The Joint Standing Committee on Intelligence (JSCI) yesterday nominated Mr Imtiaz Ahmed Fazel (30 August 2022) for the position of the Inspector-General of Intelligence.
Section 7(1) of the Intelligence Services Oversight Act, No. 40 of 1994 mandates the JSCI to nominate a candidate for the approval of the National Assembly (NA) by at least two-thirds of its Members before a candidate can be appointed as the Inspector-General of Intelligence by the President of the Republic of South Africa.
On 8 and 9 February 2022, the committee interviewed 10 shortlisted candidates for the position of the Inspector-General of Intelligence. The candidates were interviewed on relevant areas regarding the role and functions of the Inspector-General of Intelligence, based on the Constitution, the Act, other relevant legislation and other matters such as the High-Level Review Panel report.
In accordance with Section 7(1) of the Act,
The President shall appoint an Inspector General of Intelligence—
(a) nominated by the Committee; and
(b) approved by the National Assembly by a resolution supported by at least two thirds of its members:
Provided that if the nomination is not approved as required in paragraph (b), the Committee shall nominate another person.
Accordingly, the JSCI resolved by a simple majority of members present to nominate Mr Imtiaz Ahmed Fazel for approval by the NA for recommendation to the President of the Republic of South Africa for appointment as the Inspector-General of Intelligence.
