Parliament, Thursday, 15 October 2026 – The Chairperson of the Impeachment Committee for the Section 89 Enquiry, Mr Makashule Gana, noted this week that the Western Cape High Court has reserved judgment in the applications brought by the Economic Freedom Fighters (EFF) and the African Legal Professionals Association (ALPA).

The two applicants are challenging the committee's earlier decision to withdraw its recommendation of Advocate Thandazani Madonsela SC as chief evidence leader. Judgment was reserved on Wednesday after two days of oral submissions.

The Chairperson said he was confident in the committee's case, saying it had presented the facts and responded to all the applicants' arguments. "I remain confident that we presented the facts as they are, that the committee acted within the law and that there was no bad faith whatsoever on the part of the committee," he said.

He said that although he was confident the judgment would favour the committee, the committee would respect the court's decision, irrespective of the outcome. "Whatever direction the judgment takes, we will respect it and ensure that it is implemented in accordance with the law and the Rules of the National Assembly," he said.

The Chairperson said that the committee would now focus on finalising its terms of reference while awaiting the court's judgment. He also reiterated that the committee had resolved not to proceed with appointing an evidence leader until the court matter was settled.
