Parliament, Wednesday, 12 August 2026 – The Portfolio Committee on Health today officially began clause-by-clause deliberations on the Tobacco Products and Electronic Delivery Systems Control Bill.
The committee Chairperson, Ms Faith Muthambi, was satisfied with the successful deliberations on the Bill. The session focused specifically on the preamble and definitions of the Bill. Ms Muthambi noted that this focus is in line with the commitment reached during the motion of desirability. These foundational elements are critical to making the legislation robust and fit for purpose.
During the session, the committee reached a significant milestone by formally recognising the differentiation between combustible and non-combustible products, a key pillar in modernising tobacco and nicotine regulation.
Another important definition was the critical issue of illicit trade. The committee accepts that illicit tobacco products seriously undermine tobacco control measures and represent a heightened public health risk to all citizens. To address this, most committee members highlighted that the ratification of the Protocol to Eliminate Illicit Trade in Tobacco Products is crucial. This ratification will provide the necessary regulatory framework to effectively combat illicit activities while ensuring the Bill remains fully aligned with the South African Constitution.
Ms Muthambi commended the broad alignment among all political parties represented in the committee. Throughout the deliberations, Ms Muthambi made a concerted effort to ensure that every voice was heard, fostering a spirit of inclusivity and shared purpose.
She said: “The work we did today on the preamble and definitions brings us closer to fulfilling our commitment to implement a clear differentiation within the law. By listening to all perspectives and acknowledging the urgent need to combat illicit trade through international protocols, we are making this Bill stronger and more effective for the health and safety of all South Africans.”
The committee remains dedicated to a transparent legislative process as it continues its work on the remaining sections of the Bill.
