Parliament, Friday, 14 July 2023 – The Chairperson of the Committee for Section 194 Enquiry into Public Protector (PP) Adv Busisiwe Mkhwebane’s fitness to hold office, Mr Qubudile Dyuantyi, has noted another recusal application by the PP against him. He has informed the PP’s attorneys that he will respond to the application in writing by Friday, 21 July 2023.

He said Adv Mkhwebane’s grounds for this recusal application are centred on the alleged interactions between Mr David Skosana, Adv Mkhwebane’s spouse, and the late Ms Tina Joemat-Pettersson. The allegations are currently being investigated by Parliament’s Joint Committee on Ethics and Members Interests after she laid a complaint.

The application raises seven grounds for recusal. The grounds include allegations of bribery, corruption and/or extortion against Mr Dyantyi, the fact that Mr Dyantyi is the subject of a pending investigation by Parliament’s ethics committee, a pending police investigation and that the committee and/or Mr Dyantyi is proceeding with its programme despite the PP’s lack of legal representation.

Mr Dyantyi indicated that he will apply his mind to the content of the application. The committee awaits the summation of evidence from the evidence leaders. The committee has noted that Adv Mkhwebane did not indicate her intention to make a closing argument or submit a written closing statement.

The committee was established on 16 March 2021 to conduct a constitutional enquiry into the PP’s fitness to hold office. The recusal application will be provided on request. Committee documents can be found at Committee for Section 194 Enquiry - Parliament of South Africa
