Parliament, Tuesday, 14 October 2024 – The Select Committee on Cooperative Governance and Public Administration (Traditional Affairs, Human Settlements and Water & Sanitation) will tomorrow, Wednesday 15 October visit Nala Local Municipality following the invocation of Section 139(1)(b) of the Constitution by the Free State Provincial Executive.

The aim of the visit to the municipality is to assess the constitutional, procedural and substantive matters related to the intention by the Provincial Executive to invoke section 139 (1) (b) of the Constitution in the municipality.

The provincial executive cited governance, financial and service delivery challenges in invoking section 139 of the Constitution. Also, the Exco raised the challenge of unfunded budget for the 2024/25 financial year, vacancies in critical positions, collection rate of 45% and debt to creditors.

Section 139(1)(b) of the South African Constitution allows a provincial executive to intervene in a municipality by taking over specific executive functions of that municipality when the municipality cannot or does not fulfil an executive obligation.

The committee considers municipalities as critical drivers of service delivery and their functionality is critical. "Our visit is aimed to interact with internal and external stakeholders to assess the viability of the intervention," said Mr Mxolisi Kaunda, the Chairperson of the Committee.
