Parliament, Monday, 11 May 2026 – The Portfolio Committee on Cooperative Governance and Traditional Affairs (COGTA) will receive a briefing from the Department of COGTA on the Traditional and Khoi-San Leadership Bill of 2026 tomorrow.
The Bill was formally tabled and published in Parliament's Announcement, Tablings and Committee Reports document on 21 April this year. The revised Bill returns to Parliament following the Constitutional Court’s judgment in 2023 declaring the Traditional and Khoi-San Leadership Act of 2019 unconstitutional and invalid. It found that Parliament failed to facilitate meaningful public participation during the legislative process. The court suspended the order of invalidity for two years to allow Parliament to correct the legislation. An extension of the two-year deadline initially set for 30 May 2025 was granted last year, with a further extension now until 29 May 2027 to finalise the revised Bill.
The Bill that is now before the committee is substantially the same as the 2019 Act, with a few differences. Members will have an opportunity to discuss these, as well as the public participation requirements, as set out in Parliament’s Public Participation Framework.
