Parliament, Thursday, 02 December 2021 - The Speaker of the National Assembly, Ms Nosiviwe Mapisa-Nqakula, has noted the judgment of the Supreme Court of Appeal (SCA) delivered today in the matter between the African Transformation Movement (ATM), the Speaker of the National Assembly and Others.

The SCA has directed that the ATM’s request for secret ballot on the vote of no confidence in the President be referred back to the Speaker for a fresh consideration.

The judgment re-affirms the Constitutional Court judgment in the United Democratic Movement (UDM) matter that the discretion to decide on the method of vote lies solely with the Speaker. This is consistent with the principle of separation of powers within the three arms of the state as provided for in the Constitution of the Republic.

Noting that the National Assembly's processing of the ATM's motion was suspended pending the judicial process, the Speaker will therefore await the party's indication to proceed with it before considering it afresh and making a decision, after consulting all the relevant stakeholders.
