Have Your Say: The 2026 Draft Rates and Monetary Amounts and Amendment of Revenue Laws Bill (Draft Rates Bill), the Draft Taxation Laws Amendment Bill (Draft TLAB), and the Draft Tax Administration Laws Amendment Bill (Draft TALAB)
The Standing Committee on Finance invites stakeholders and interested parties to submit written submissions on the 2026 draft Rates and Monetary Amounts and Amendment of Revenue Laws Bill (draft Rates Bill), the draft Taxation Laws Amendment Bill (draft TLAB), and the draft Tax Administration Laws Amendment Bill (draft TALAB)
The draft Rates Bill aims to:
Fix the rates of normal tax; to amend the Income Tax Act, 1962, so as to amend certain provisions; to amend the Customs and Excise Act, 1964, so as to amend rates of duty in Schedule 1 to that Act; to amend the Value-Added Tax Act, 1991, so as to amend thresholds; to amend the Diamond Export Levy Act, 2007 so as to amend certain provisions; to amend the Carbon Tax Act, 2019, so as to amend an amount; and to provide for matters connected therewith.
Key proposals contained in the draft TLAB include, amongst others, the following:
Determining the application of the de minimis limit for a lump sum where multiple living annuities are held; Limiting the donations tax exemption rule where a spouse is a non-resident; Special economic zones: introduction of domestic transfer pricing rules; Leasehold improvements; Refunds for carbon budget compliance.
Key tax proposals contained in the draft TALAB include, amongst others, the following:
Providing an enabling provision relating to Admission Temporaire/Temporary Admission carnets (ATA Carnets); Expanding documentary requirements for second-hand goods; Permitting pre- or post-deposit screening of refunds by banks; Interest relief on defaults disclosed during voluntary disclosure application.
Public hearings will be held on Wednesday, 30 September 2026
Submissions must be received by no later than 12:00 on Monday, 28 September 2026.
