Parliament, Tuesday 3 May 2022 – During its hybrid plenary this afternoon, the National Assembly (NA) passed the Local Government: Municipal Systems Amendment Bill.

The Local Government: Municipal Systems Amendment Bill provides for the repeal of the Municipal Systems Amendment Act No.7 of 2011 which was declared unconstitutional in 2017, for failure to comply with the procedures as set out in section 76 of the Constitution.

The Bill seeks to make provision for the appointment of municipal managers and managers directly accountable to municipal managers. It further provides for among others procedures and competency criteria for such appointments and for the consequences of appointments made otherwise than in accordance with such procedures and criteria.

The Bill was processed by the Portfolio Committee on Cooperative Governance and Traditional Affairs and subsequently passed by the NA and sent to the National Council of Provinces (NCOP) for concurrence on 3 December 2020.

The NCOP’s Select Committee on Cooperative Governance and Traditional Affairs, Water, Sanitation and Human Settlement deliberated and processed the Bill. The Committee proposed amendments to the Bill. Having considered the amendments, the NCOP adopted the amendments and sent the Bill back to the NA for consideration.

The NA’s Portfolio Committee on Cooperative Governance and Traditional Affairs having further deliberated on the Bill agreed to the amendments proposed by the Select Committee on Cooperative Governance and Traditional Affairs, Water, Sanitation and Human Settlement.

The Bill will now be sent to the President for assent.
