Parliament, Monday, 5 March 2018 – The Portfolio Committee on Cooperative Governance and Traditional Affairs (CoGTA) will tomorrow (Tuesday, 6 March) receive a progress report on the implementation of forensic investigations that were instituted against a number of municipalities across the country.

A number of forensic investigations were commissioned by the national Department of Cooperative Governance and Traditional Affairs in 2009 following allegations of corruption and related offences at municipalities. Reports on these forensic investigations were requested from provinces as far back as 2014.

The committee will also be updated on the process of dealing with the Constitutional Court judgement which invalidated the Municipal Systems Amendment Bill (2011). The Bill was introduced in Parliament in 2010 and was later tagged as a Section 75 Bill – a Bill that does not affect provinces. The South African Municipal Workers’ Union (Samwu) contended that this Bill affects provinces and ought to be tagged as a Section 76 Bill. In 2016, the Gauteng North High Court found in favour of the union and invalidated the Bill. The challenge also went to the Constitutional Court where the decision of the High Court was upheld.
